. a footnote, this might be a pyrrhic victory for the defense if they win because even if they win with the summers issue, the government can still argue that it was a legitimate, they had a reasonable suspicion, and, therefore the evidence obtained could still be admissible. i was asked to talk about another case which is a case -- >> why don't you take a minute and a half? >> maryland vs. king, and the question is here to the liberty of the state and federal laws that allow for the collection of swabs of cells from the insides of mouths of people who have been arrested. there as 27 states who have laws allow officers to swab the inside of any mouth of anybody arrested, and that gets put into the system who helps to identify the person, but also connect them to other crimes. in this case in maryland, king was arrested for burglary, swabbed, it comes back with a hit for a case involving rape. the court of appeals ultimately found it should have been suppressed, thereby invalidating the law in maryland which is the law in 26 other states allowing that swabbed people are arrested. th

appears on the stage is very important. normally when a candidate gets defensive that is when they started looking bad. that happens with barack obama. it happened when he told hillary she was like have likable enough. it happened with mitt romney when he did the $10,000 bet with governor perry. it's very important that governor romney keeps making the case about the economy and keep pushing an alternative vision that the american people can see as a better path and a better way forward to improving the economic conditions. if he does that he will put the president on the defensive. if he allows the president to sort divide the audience, talk about women and myth of the war on women and talk about the middle-class and divide the country and gets on the defensive or talk about issues that are irrelevant to the economy, then that is place where governor rom can look at defensive and may not look as good to the audience. >> is it possible to be too prepared for the debate and candidate appears to be reading off a card imprinted in the back of his head because people are pounding him with info

obam has to connect those two things. he can't get defensive. the president, on the other hand, has to deflect from that. he has to make the debate about the choice between himself and governor romney and press him about specifics. try to make the argument that the -- that governor romney's policies would take us off of a path of recovery we might be on right now. and he can't get defensive as well. both men, when they get into the defensive posture, tend not to do very well in debates. >> what do you think is the most treacherous ground for each of them? what is the thing often -- i'm sure you've studied a zillion hours of debate tapes. what triggers debates in both of them? >> when both get on defense, when they have to defend positions they're uncomfortable with, they tend to get defensive. that's what caused the $10,000 bet with governor romney and that what caused the moment where president obama, then senator obama, told hillary she was likeable enough. i think both of them, when put on their heels, tend to make mistakes. >> let's play a clip of that from the hillary clinton/b
